Terms of Service

1. Acceptance of Terms

By accessing or using Kotonaut ("the Service"), operated by Kotonaut ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Kotonaut is a SaaS platform that automates direct message (DM) responses on Instagram and Facebook. When a user comments a keyword on your connected social media account, Kotonaut automatically sends a pre-configured DM to that user using Meta's official APIs.

3. Account Registration

  • You must provide accurate and complete registration information.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 18 years old to use the Service.
  • One person or legal entity may not maintain more than one free account.
  • You are responsible for all activity that occurs under your account.

4. Meta Platform Compliance

By using Kotonaut, you agree to:

  • Comply with Meta's Platform Terms, Community Standards, and all applicable policies.
  • Only use the automated DM feature for legitimate business purposes (e.g., responding to customer inquiries, providing requested information).
  • Not use the Service to send spam, unsolicited promotional messages, or harassing content.
  • Maintain valid admin or editor access to any Facebook Pages or Instagram Business accounts you connect.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal, fraudulent, or harmful purpose.
  • Send DMs that contain misleading, deceptive, or harmful content.
  • Attempt to circumvent plan limits, rate limits, or other usage restrictions.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Resell or redistribute access to the Service without our written consent.
  • Use the Service in any way that could damage, disable, or impair the platform.

6. Plans, Billing & Payments

  • Free accounts are subject to the limits described on our pricing page (1 account, 3 triggers, 100 DMs/month).
  • Paid plans are billed monthly via Stripe. Your subscription renews automatically unless cancelled.
  • You may upgrade, downgrade, or cancel your plan at any time from your dashboard. Changes take effect at the start of your next billing period.
  • We reserve the right to change pricing with 30 days' notice. Existing subscribers will be notified via email.
  • Refunds are handled on a case-by-case basis. Contact support@kotonaut.com for refund requests.

7. Service Availability

We strive to maintain high uptime but do not guarantee uninterrupted service. The Service depends on third-party APIs (Meta, Stripe, Supabase) that may experience outages outside our control. We are not liable for any damages arising from service interruptions.

8. Intellectual Property

The Service, including its design, code, and documentation, is owned by Kotonaut and protected by intellectual property laws. You retain ownership of any content (DM templates, trigger configurations) you create within the platform.

9. Limitation of Liability

To the maximum extent permitted by law, Kotonaut shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Kotonaut, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights (including Meta's platform policies).

11. Termination

  • You may delete your account at any time from your dashboard settings.
  • We may suspend or terminate your account if you violate these Terms, abuse the platform, or engage in activity that harms other users or the Service.
  • Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.

12. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the platform. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to conflict of law principles.
